5 Mechanical Breakdown

Time on Bikes will pay the cost of repair of any mechanical breakdown except tyre failure.

Time on Bikes will pay the cost of recovery of the bike to be repaired, unless:

(a)    The Bike is used on a road or property that is not designed or recommended for access by a conventional two wheel drive vehicle; or

(b)    The Bike is more than 50km from a sealed road.

Where (a) or (b) applies, the Hirer shall pay the cost of recovery to the location of an appropriate repairer.

In the event of a breakdown, The Rider shall contact Time on Bikes on 0419 791 186 or 0438 924 265 to receive instruction.  If Time on Bikes is uncontactable, The Rider shall send a detailed text message and make reasonable steps to recover and repair the bike, or secure the bike and seek transport to an appropriate destination.  Time on Bikes will reimburse reasonable costs of the repair and recovery and transport. Relevant tax invoices must be provided to Time on Bikes for reimbursement.

Where The Rider is stranded due to a mechanical breakdown other than tyre failure, Time on Bikes will, at its discretion, after consultation with The Rider:

(c)     Deliver a replacement bike to The Rider; or

(d)    Pay for accommodation while The Bike is repaired; or

(e)    Pay for transport for The Rider to return to their residence in Australia; or

(f)     Pay for transport to the next place on the Rider’s itinerary that Time on Bikes can arrange a replacement bike.

Transport paid for by Time on Bikes will generally be coach or train from regional areas, or air transport from major cities.

6 Tyres

The Hirer agrees to bear the cost of tyre repair in the form of $50 per failed tyre. 

Unless the tyre is virtually brand new, The Rider shall arrange a replacement tyre if available.  Time on Bikes will

(a)    pay the tyre supplier directly and add $50 of charges to The Hirer; or

(b)    reimburse The Hirer the cost paid by them minus $50 Tyre charge

Time on Bikes will not charge the $50 fee for tyres that were scheduled for imminent replacement.

Enduro (dirt) Tyres carry a surcharge due to their high wear out rate. The Hirer may choose to fit their own tyres appropriate for their use to the bike to avoid tyre charges, and return The Bike with street legal tyres of similar condition to those The Bike was supplied with.  Enduro Tyre Surcharges are:

              1^st week: $200 enduro tyre surcharge (i.e bike has brand new tyres)

              2^nd week: $100 enduro tyre surcharge (tyres have been used for a week before the hire)

              3^rd and subsequent weeks (or The Hirer supplies tyres) $0

Where the tyre surcharge applies, Time on Bikes will replace tyres when required or requested by The Hirer up to every 2^nd week.

7 Time Unavailable

Time on Bikes, The Hirer, and The Additional User agree that each party will bear any loss incurred to themselves due to the unavailability of the bike due to damage, theft, the actions of another Time on Bikes customer, or mechanical breakdown of The Bike. 

For time unavailable due to mechanical breakdown or the actions of another Time on Bikes customer, Time on Bikes will provide replacement hire at the next available opportunity, or a pro-rata refund of the hire fee.  The Hirer and The Additional User shall have no claim for loss of enjoyment, profit, attendance at a scheduled event, or any other loss caused by the unavailability of The Bike at a particular time.

For time unavailable due to damage or theft, The Hirer shall forfeit the hire fee for the corresponding period.  Time on Bikes will have no claim for loss of profit or other loss caused by the unavailability of the bike other than the direct damage or injury costs as listed in the corresponding sections of this agreement.
