3 Death and Injury

The Rider is responsible for any liability for injury or death of any person (including self) caused by The Rider’s use of The Bike other than that covered by compulsory third party insurance on The Bike. The Rider shall indemnify and hold harmless Time on Bikes with respect to any such injury, or any consequential loss as a result of injury.

Unless covered by compulsory third party insurance on The Bike, Time on Bikes’ liability for injury or death shall be limited to that caused by acts or omissions of Time on Bikes, and only to the extent that they contribute to the death or injury.  This will not exclude any liability of Time on Bikes that cannot be excluded by law.

The Hirer shall limit the risk of injury to themselves and others by:

(a)    Only allowing The Bike  to be ridden by riders who can reasonably be expected to operate it competently given the conditions and experience of The Rider

(b)    Fully disclosing the true riding history of The Hirer and The Additional User to allow an appropriate selection of The Bike to be hired.

(c)     Ceasing to ride The Bike if a safety defect is noticed by The Rider or for minor defects adjusting riding style to ride The Bike to a repair facility if safe to do so.

4 Damage and Theft

The Hirer and The Additional User shall act to prevent damage to The Bike or the property of a third party as much as is reasonably practical.  UNDER NO CIRCUMSTANCES should The Hirer or The Additional User place the prevention of damage or theft any property ahead of the prevention of Injury or Death of themselves or others.

The Hirer is responsible for the first $2000 of damage to or theft of The Bike or damage to the property of a third party.

The Hirer is responsible for ALL damage to or theft of The Bike and damage to the property of a third party when:

(a)    The Bike is used on a road or property that is not designed or recommended for access by a conventional two wheel drive vehicle; or

(b)    The Bike is used by other than The Hirer or The Additional User; or

(c)     The Bike is used by any person with a Blood Alcohol Concentration 0.01% or greater, or under the influence of any substance which is prohibited by law or medical direction for operation of motor vehicles; or

(d)    The Bike is used illegally, including unlicensed riding or breach of the class or conditions of the rider’s licence; or

(e)    The Bike is used in any event (competitive or recreational) where a written agreement or waiver is required to participate by the event operator, or not held on public roads.

(f)     The security devices provided with The Bike are not applied when it is parked and not kept in sight of The Rider.

Time on Bikes may, at its complete discretion, waive minor damage to The Bike where the total cost of the repair is less than the hire fee paid.

Time on Bikes may agree to a payment plan for The Hirer to reimburse damage costs by instalment.  All damage must be paid for within 12 calendar months of any damage.  An administration fee of $20 per month will be charged to manage the outstanding balance until fully paid.
