14 Booking and Cancellation

If The Hirer requires The Bike to be pre-booked, or if Delivery is requested, The Hirer must pay a deposit of 1 weeks hire or the full hire fee if less than 1 week has been booked. 

A Booking will cause Time on Bikes to reserve The Bike to be hired at the agreed time.  Time on Bikes cannot guarantee the availability of The Bike for situations beyond its control. If The Bike allocated becomes unavailable due to breakdown, damage or failure of a previous customer to return The Bike on time, Time on Bikes will supply an alternative or offer a refund or alternative time. 

If The Hirer cancels the hire or does not meet Time on Bikes at the agreed time and place to collect The Bike, a cancellation fee of 1 weeks hire (or the full hire fee if less than 1 week has been booked) shall apply.

15 Delivery and Pickup Fees

A Fee will apply for delivery or Pickup of The Bike to a location other the Time on Bikes premises

16 Parking

Any vehicle The Hirer or associates of The Hirer parks at Time on Bikes or its landlord’s premises are parked at the vehicle owner’s risk.  Keys to the vehicle must be left with Time on Bikes if it is parked inside a Time on Bikes building or it is being offered as a security deposit for hire of The Bike.

17 Credit Card Charges

Credit Card Payments above $1000 will attract a processing fee of 2% charged to the Hirer by Time on Bikes. 

18 Security Deposit

A Security Deposit will be paid by The Hirer to Time on Bikes before The Bike is released to The Hirer.   The Security Deposit must be from an account or card in the name of The Hirer.  Time on Bikes may accept another form of security (such as a vehicle) where evidence of ownership can be given by The Hirer.  Time on Bikes may apply secondary locking devices or relocate any asset being held by Time on Bikes as security.

The Security Deposit required will be based on the home state and address of The Hirer:

Bank transfers or cheques (paid well in advance to allow cheque clearance) are preferred by Time on Bikes for large security deposits.

19 Privacy policy

Time on Bikes will retain details of The Hirer for the purposes of ensuring the security of its assets and meeting other obligations in relation to the use of those assets.  The Hirer and The Additional User agree that:

(a)    Time on Bikes may photograph The Hirer for the purposes of identification, will retain and may provide this photograph to any investigating authority for any legal investigation of the use of The Bike.

(b)    Time on Bikes may photograph or photocopy The Hirer’s and The Additional User’s Drivers licence for the purposes of determining the suitability of The Bike, and for ensuring security of its assets.  Time on Bikes may provide the licence details or a copy to any investigating authority for any legal investigation of the use of The Bike including in response to the issue of a camera detected offence notice to Time on Bikes.

(c)     Time on Bikes may monitor and/or record the location, speed, surrounding audio, or surrounding video image of The Bike at any time.  Time on Bikes may use any available technology to undertake this monitoring or recording.  Time on Bikes will limit its use of any information collected to ensuring the security of its assets, or providing information to a governing authority for legal investigation regarding the use of The Bike.

(d)    Deletion of (a) and (c) immediately above will invoke a requirement for 100% security deposit.

20 Abuse of The Bike

If The Hirer causes or allows abuse of The Bike, including deliberate excessive tyre use, deliberate over revving of the engine, or use of The Bike outside reasonable use for the type of vehicle, The Hirer forfeits the security deposit.  Time on Bikes will not unreasonably enforce this clause, and may partially refund the deposit if appropriate.  Time on Bikes may refuse any future hire under this clause.

21 Traffic Offences

Traffic offences committed by The Rider will be the sole responsibility of The Rider. 

Where an offence is committed due to the condition of The Bike:

• ·       Time on Bikes will reimburse the value of the fine to The Rider if an offence was caused by the condition of The Bike when accepted by The Hirer.   Demerit points will still apply to The Rider.
• ·       The Rider remains fully responsible if an offence related to the condition of The Bike was caused by the manner of operation by The Rider.
• ·       The Rider remains fully responsible if the condition of The Bike deteriorates during the hire and The Rider failed to notify Time on Bikes of the deterioration.

22 Security from Theft

The Rider shall utilise any security device provided by Time on Bikes when The Bike is not parked in full view and monitored by The Rider. 

The Rider shall lock the Ignition/steering lock of The Bike and remove the ignition key whenever The Rider is to be more than 10 metres from The Bike.

23 Immediate Termination of Hire

Time on Bikes may immediately terminate the hire of The Bike if it has reasonable suspicion that the hire terms are being breached, that its assets are not under adequate care, or The Rider’s safety is not being adequately managed.  In the event of immediate termination, Time on Bikes will advise The Hirer that The Bike must be immediately returned or secured at its current location for collection by Time on Bikes.  Time on Bikes may initiate a report of suspected theft if The Rider fails to cooperate to allow the safe return of The Bike.  Time on Bikes will not act unreasonably to immediately terminate the hire, or make unreasonable demands on The Hirer regarding the time or place of return.

24 Tolls

All road tolls and permits for traversing any road are the responsibility of The Hirer.  The Hirer shall reimburse any such charges received by Time on Bikes

25 Return of Security Deposit

Time on Bikes will retain the security deposit until it is satisfied that The Bike is undamaged, and all tolls, fines or any other obligation by The Rider has been settled.  This may take up to 7 days.  Time on Bikes will make all reasonable effort to return security deposits as soon as reasonably practical.  The method of returning the Security Deposit will be by business cheque or by bank transfer to a nominated account in the name of The Hirer.

26 Return of The Bike

The Hirer agrees to return The Bike to the agreed place at the agreed time.  Extension to the hire period is subject to pre-approval by Time on Bikes.  Extensions are subject to availability and at the discretion of Time on Bikes.  The Hirer agrees to notify Time on Bikes of any likely late return.  Late return will incur additional hire fees.  Time on Bikes may report a suspected theft if The Bike is late for return.
